  1. I am a resident of NJ. Can I open carry when I am in Delaware?

    1. I dont see why not if you have a CcW permit. Its not just for handguns.

  2. Why doesn’t DE have constitutional carry? Is the First State going to be the Last State to grant the constitutional carry right accorded by the 2A? Just curious…

  3. It this time of my life I think I’m mature enough and old enough to operate in carrying firearm for my protection and my families. And with the permission of the state of Delaware I do have I can receive one

    1. Carry In State Parks Allowed …. A recent court decission allows carry in State Parks with a few minor exceptions such as administrative offices.

      1. Do you still have to turn in guns if you get a medical marijuana card.

        1. Driving through Delaware coming from Florida heading to NJ. All the states require me to separate the ammo from the pistol and locked the pistol in my trunk. So when I get to Delaware I should take it out of the locked trunk and put it in the open on my seat?

  4. I have a question I have a concealed carry permit from a state delaware has a reciprocal Agreement with but in some states it’s legal , even with CCW permit to have the gun loaded with a bullet in the chamber when carrying it , I’m checking if it is legal or illegal to carry a chambered hand gun in Delaware , thank you

    1. There is no law stating how you carry or conceal your firearm. I carry mine chambered at all times.

    1. 3 months …once it hits the federal level your golden. When you buy a gun at a gun store , when they run your name it will come back delayed …that means you pay for the gun and after 3 days you go back and get it.

  5. Is it legal for an out of state buyer to purchase a gun in Delaware? Example: i live in NY and want to purchase a rifle in Delaware that i have a certain amount of time to register in NY. I know I can purchase a gun in PA as I’ve done so before but would like to know if this is also possible in Delaware

  6. Can a retired police officer from nj carry in Delaware with his retired carry permit

    1. No the New Jersey ccw is not honored here you can open carry but you can’t conceal in Delaware without our permit

    2. Retired police officers in good standing are covered by federal law, The Law Enforcement Officers Safety Act, Title 18 USC 926(c). If you are qualified under that law, then you may carry concealed in all 50 states except on state and local government bases, buildings, installations, premises, and parks, and where prohibited by federal law. You can carry concealed in Delaware as long as you have your retired photo ID from your former law enforcement agency, are sober, and have passed an approved handgun qualification with the past year. Your New Jersey CCW is irrelevant.

  7. Do prior military have to go through the gun orientation course or are they exempt from any of this. Are there any steps prior military are exempt from doing?

    1. I just moved to Delaware from another state. Am in the Army reserved. I don’t know anybody in Delaware. How can i get the pistol permit

  8. I have a permit in the state of Pa and have a 2nd residence in Delaware. To apply for a permit in Del must I go through all the steps of a person who does not have a permit in any other state.

    1. William, I am interested in the answer to your question as well. Would you mind sharing your answer when you get a reply/
      Thank you!

  9. What if someone left a gun in your car and they have license to carry? What happened to the person with a felony ?

    1. If it’s your car your in possession be careful and now what’s in you car and make sure it’s stored properly or it could result in a charge

  10. I am just wondering what the gun laws are for shooting on your own property. If there is a limit to size and what the radius is away from buildings etc

  11. As a Pennsylvania resident, if I get a non-resident permit in a state like Ohio that has reciprocity with Delaware, would I be able to carry concealed in Delaware?

  12. In the state of Delaware can you carry a shotgun on a gun rack in your truck if you are under 18

  13. Need some info moving to the state end of month have a conceal carry from NYC, also have hr 218, what paper work needed to transfer to new resident retired Leo

  14. Can You Ride Around With A Legal Gun And Not Have A Valid Drivers license? ???

  15. I got my fingerprints done a couple months ago. Trying to get the other steps done along with my son so it took a little longer than expected. The form says fingerprints must be obtained within 45 days of applying. Has anyone filed outside of this period? It sounds like I may need to have the fingerprints done again. Did I waste the $65 fee I paid the first time?

    1. Yes you did waste your money. I believe your fingerprints are only good for 60 days. As long as you send your paperwork before that time period your good. Not sure if they will accept outside of the allotted time period.

    2. Yes, you have to get them redone. That was the last thing I did because of the time frame.

    1. Yes you can, the firearm is then out of your reach. Or you could just keep it loaded and in plain sight since open carry is legal.

  16. Can a private clubhouse in Delaware ban weapons from owners that have a concealed and carry permit?

  17. Does Delaware accept autos made by the coat hanger sear in an ar15 lower with a permit. If so where do you get the permit/license

  18. Can you have your gun load while driving or does the magazine have to be

      1. I was just told by police that if I’m in my car and I’m openly carrying it need to be unloaded and magazines can’t be near my gun also is hollow points ok to have in your gun while in DE

  19. Traveling from SC into NJ for the day. I have my SC permit, but I am not looking to carry where my permit is not excepted. In those states, like Delaware, is it legal to lock my gun in its case and transport it through said states?

    1. virginia ok. delaware ok. maryland ok if you unload magazines and keep ammo in separate box and gun in locked box and all in the trunk. new jersey uh not really

    2. You must be legally able to possess the firearm in the departure state as well as the state you’re traveling to for FOPA to protect you.

And as I assume you don’t have a gun license in NJ it technically won’t cover you for any state.

Even if you were just traveling through nj, I wouldn’t trust them too not violate federal law to pad their numbers regardless. Same with ny, ma, me, etc.

  20. For the Utah non resident license is their anything I need to know befor carrying in DE thanks

    1. yes if your not a resident of the issuing state (Utah), you may no longer carry conceled in Delaware. .

  21. Looking at the reciprocity map, I see I can carry at my daughter’s house in Ohio. What do I need to do to get there legally? (MD, PA)

  22. I currently live in South Carolina and am a SC and Utah CWP holder but am moving back to DE soon. Delaware is a reciprocal state of Utah’s CWP but only issues DE permits to residents. Once I move back are my SC and Utah CWP’s invalid and I have to take a course again for Delaware?

    1. You must have DE permit to carry concealed if you reside in DE.

  23. If my boss at work says it’s okay to carry there can I take it. I bike to work and I work in a small local business so it’s not a major corporation

  24. If you have a ccw permit can you have a hand gun in the center console of a pickup ? Loaded or unloaded ? Everyone i talk to has a different opinion. With a permit what type of ammo can you have in the gun ? Iwas told round nose bulletts but some people tell me they have to be hollow points.

    1. If you have a ccw permit for Delaware you can have it anywhere loaded with any type of ammunition. If you dont have a Delaware ccw permit it has to be in plain sight & can be loaded with any ammo.

      1. This is a correction to the very first comment by Corey. If traveling with a gun in Delaware without your ccw, it has to be unloaded and secured. Ammo must be separate from weapon.

        1. Bailey- false. Open carry allows the weapon to be loaded but must be visible – on the seat or dashboard for example

        2. incorrect…with Delaware open carry…if traveling in a vehicle…the gun maybe loaded but must be in plain view…on the seat, console etc. In SC it may be transported loaded in the glove box w/o a conceal carry permit under the Castle Doctrine…open carry in Virginia…may be ,loaded but again must be in plain view

    2. Either are legal as long as they are not armor piercing. People say carry the hollow because they slow or mushroom when they hit something. Have to remember you pull the trigger you own the bullet. As for your ccw center console question, yes you can put in glove box or center console and why carry a gun that’s not loaded? Remember your carrying a gun if you pull it the other person may have one too and it’s loaded no one is going to g to wait for you to load your gun.

  25. Can I open carry a blank firing handgun obviously couldn’t hurt anyone but if I was in a situation and needed to scare someone to get them away from me and hoping they don’t have a firearm would it be legal to open carry and also could I open carry my black powder revolver and of course unloaded god forbid I have to hide and wait ten mins to even try to load her up but just wondering if I would get in trouble and or lose my guns

    1. A blank gun CCW will get you killed. You are not going to bluff anyone. My suggestion to you is do not carry weapon. .

    2. You can be charged for pointing a blank gun at an unarmed assailant. Just stay home. Your thought process is going to get you killed

  26. In the state of Delaware. When open carrying is my fire arm allowed to be loaded. Or do I have to have it unloaded?

    1. if you aren’t going to load it, what’s the point?
um, excuse me mister bad guy, could you just hold a second while I load my magazine and then rack the slide. ok now I am ready. so please stick em up!

  27. Ok so this is a real question back in 2013 I was put in a psychic evaluation center but was discharge from there dose it prevent me from owning a firearm if I was cleared and never admitted to the mental house.

    1. Yes, even if they have a no guns sign on the door. Open carry in banks is perfectly fine as well

  28. I plead guilty to stealing mail. Does that disqualify me from purchasing a rifle.

  29. i lived in wva and i moved to de with a wva concealed permit is it still legal

  30. I’m visiting Delaware and have a New York and Utah full carry pistol permit am I allowed to carry in delaware

    1. I checked my CCW app with a resident NY and non-resident Utah permits and it says your permits are honored. I am not an attorney or giving legal advise, my advise would be to check with a 2A attorney before doing so. However, I carry and use the CCW app on a regular basis and have never found it to be wrong. Stay safe.

      1. Join the discussion…Only resident Utah permit is honored. If you have a non resident Utah it is no longer good in DE.

        1. According to ,

Delaware Recognition of Permits By Other States To Carry Concealed Deadly Weapons Issued To Residents Of Other States

Delaware recognizes licenses or permits to carry concealed deadly weapons issued by other states to the citizens of other states where those states honor Delaware licenses to carry concealed deadly weapons, afford a reasonably similar degree of protection as is provided by licensure in Delaware, and do not evidence a pattern of issuing licenses or permits to convicted felons. Some states issue multiple levels of permits or licenses; only those meeting the above requirements will be recognized in Delaware and a notation of the recognized permits appears with the state below.

Persons possessing a recognized license or permit to carry a concealed deadly weapon issued by one of the states listed may lawfully possess a concealed deadly weapon while in Delaware. Such persons are subject to and responsible for knowing and obeying all Delaware laws and regulations applicable to carrying or possessing of deadly weapons.

For the period from January 15, 2018 to January 14, 2019, Delaware recognizes the concealed deadly weapon licenses or permits issued by following states:

          IDAHO (Enhanced Permits Only)
          NEW MEXICO
NORTH DAKOTA (Class 1 permits only)
          SOUTH DAKOTA (Enhanced Permits Only)

          1. Actually Delaware stopped honoring non resident permits from other states some time ago. It’s amazing how ignorant of current laws people are. Enjoy your time in Gander Hill.

    2. Permitless open carry is permitted anywhere in the state now (except for certain areas in state parks). You can forgo the whole permit issue all together and just OC, as I do myself, and no have to worry about committing a felony.

      1. Hey Dan, how do you travel while open carrying? Can it be in plain sight loaded or separate? I can’t find anything that spells it out.

    3. Yes, Delaware is a reciprocal state for a Utah CWP. Just be careful if you are driving and traveling through other states to get to Delaware. Many states such as MD and NJ surrounding DE do not honor an out of state CWP and have pretty harsh punishments if caught carrying in that state, even if you’re only passing through.

      1. Maryland has very harsh punishment for concealed or open. Carry even if you just passing through.

        1. I’m a law enforcement officer and covered by LEOSA. The county prosecutor still charged me with unlawful possession of a firearm. When it went to court, the prosecutor actually told me he’d never heard of LEOSA. Had to pay a fine and do a week of community service for the charge to be dropped.

          1. Maryland that is. I just noticed I forgot to state that it was Maryland.
